Terms of Service — MintedModels

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of MintedModels.com and related services (the “Platform”).

By creating an account, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

The Platform is operated by Minted Models Ltd (EU), a company established within the European Union and operating internationally in accordance with applicable European Union, United Kingdom, United States, and other applicable laws and regulations.

2. Eligibility and Age Requirements

2.1 General Eligibility

You must meet the minimum age required to lawfully use online services in your jurisdiction.

Adult users may create accounts for themselves directly.

Accounts for individuals under 18 (“Junior Accounts”) may only be created, managed, or authorised by:

a parent,
legal guardian,
licensed agency,
or other authorised adult representative acting with lawful authority.

By creating or managing a Junior Account, the responsible adult confirms that:

they have authority to act on behalf of the minor,
all information provided is accurate,
and the account complies with applicable laws and safeguarding requirements.

2.2 Junior Accounts

Junior Accounts are intended solely for lawful non-adult purposes, including:

fashion modelling,
commercial modelling,
acting,
talent promotion,
portfolio hosting,
and similar professional activities.

Junior Accounts:

cannot access adult content areas,
cannot upload adult content,
cannot use adult-oriented services,
and are subject to additional moderation, visibility, and safety restrictions.

Access to adult features is technically restricted for Junior Accounts through platform controls.

2.3 Adult Accounts and Adult Content

Users must be at least 18 years old to:

access adult content,
upload adult material,
use adult categories,
or access adult-oriented services or features.

Users accessing adult areas may be required to complete age or identity verification procedures.

2.4 Verification and Enforcement

We reserve the right to request identity, age, parental consent, agency authority, or other verification documentation at any time.

We may suspend, restrict, or terminate accounts where:

age or authority cannot be reasonably verified,
false information has been provided,
required parental or representative involvement is absent,
or we reasonably believe the Platform is being used unlawfully, unsafely, or in breach of these Terms.

3. User Accounts and Security

You are responsible for:

maintaining the confidentiality of your login credentials,
all activity occurring under your account,
and ensuring your account information remains accurate and up to date.

You must not:

share accounts with unauthorised persons,
impersonate another person,
create misleading or fraudulent profiles,
or attempt to gain unauthorised access to the Platform or other user accounts.

Parents, guardians, or authorised representatives managing Junior Accounts are responsible for activity conducted through those accounts.

4. User Content and Platform Role

MintedModels is a user-generated content platform. Profiles, photographs, text, portfolio material, and other content are uploaded directly by users or their authorised representatives.

We do not always pre-approve or actively monitor all content before publication.

Users are solely responsible for ensuring that content they upload:

is lawful,
does not infringe third-party rights,
complies with these Terms,
and is appropriate for the account type and age category involved.

We reserve the right to remove, restrict, moderate, investigate, or review any content or account at our discretion.

5. Acceptable Use

You agree not to:

upload false, misleading, fraudulent, or deceptive content,
harass, abuse, threaten, or exploit other users,
upload content you do not own or have permission to use,
upload illegal, abusive, hateful, violent, exploitative, or sexually unlawful material,
attempt to bypass platform restrictions or safety systems,
scrape, harvest, or automate collection of platform data,
interfere with platform security or operation,
or violate any applicable law or regulation.

6. Adult Content Policy

Certain sections of the Platform may contain adult-oriented material intended only for verified adults.

Users uploading adult content confirm that:

all persons depicted are at least 18 years old,
all participants gave informed and lawful consent,
and the content complies with applicable laws and regulations.

Content involving minors in a sexualised, exploitative, explicit, or otherwise unlawful context is strictly prohibited and will result in immediate removal, account termination, and referral to relevant authorities where appropriate.

Lawful non-adult portfolio images of under-18 models used for fashion, commercial, acting, talent, promotional, or similar legitimate purposes are permitted within appropriately restricted Junior Account categories.

We comply with applicable United Kingdom, European Union, United States, and international laws relating to online safety, illegal content, age assurance, child protection, and digital services where applicable.

Access to adult content may vary depending on jurisdiction, local law, or verification status.

7. Subscriptions and Payments

Certain features of the Platform may require a paid subscription.

By purchasing a subscription, you agree that:

subscriptions renew automatically unless cancelled before renewal,
billing intervals are as displayed at checkout,
and payments are processed securely through third-party payment providers.

Prices, features, and subscription structures may change from time to time.

Refund requests are handled in accordance with applicable consumer protection laws.

To request billing assistance, cancellations, or refund reviews, users should contact platform support through their account where possible.

8. Intellectual Property and Content Licence

8.1 Ownership

You retain ownership of content you upload to the Platform.

8.2 Licence to Operate the Platform

By uploading or publishing User Content on the platform, you grant MintedModels a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt, publish, display, distribute, and use such User Content for the purposes of:

operating and improving the platform,
displaying profiles and portfolio content,
promoting your profile or activity on the platform,
advertising and marketing MintedModels across websites, social media, digital advertising, email campaigns, and similar promotional channels,
creating promotional materials relating to the platform and its community.

This may include resizing, cropping, formatting, watermarking, or otherwise adapting content for technical or promotional purposes.

You confirm that you have all necessary rights, permissions, and consents required to upload the content and grant this licence.

This licence ends when the content is permanently removed from the platform or your account is deleted, except where retention is reasonably necessary for:

backups and technical archives,
legal compliance,
fraud prevention,
enforcement of legal rights,
investigation of abuse or illegal activity.

MintedModels does not claim ownership of your User Content.

8.3 Promotional Use

You additionally grant us permission to use uploaded profile images, usernames, portfolio previews, and related public profile content:

in Platform marketing,
on official social media channels,
in digital advertising,
in search engine and social media campaigns,
and in promotional materials used to market either:
your profile,
or the Platform generally.

Promotional use may include social media platforms, online advertising networks, search engines, mobile applications, and partner promotional channels operated by or on behalf of the Platform.

This permission is limited to the promotion of the user and the Platform and does not transfer ownership of your content to us.

We will not sell uploaded images as standalone stock photography or independent commercial image products, or to any third parties without separate explicit consent.

For Junior Accounts, promotional use may be limited, restricted, or require parent, guardian, agency, or representative authorisation where legally required.

You may request removal of promotional usage by contacting platform support, although previously published campaigns may remain in circulation for a reasonable period.

9. Copyright and Reporting

Users must only upload content they own or are authorised to use.

If you believe content infringes your copyright or other rights, please use the platform reporting tools available on the relevant profile or image.

We may remove disputed content while investigating complaints.

We may also respond to valid copyright notices submitted under applicable international copyright laws, including the United States Digital Millennium Copyright Act (DMCA) where applicable.

10. Privacy and Cookies

Our collection and use of personal data is governed by our:

Non-essential cookies and advertising technologies are only activated where legally required consent has been obtained.

11. Suspension and Termination

We may suspend, restrict, or terminate accounts at any time where we reasonably believe:

these Terms have been breached,
the Platform is being misused,
unlawful activity may be occurring,
or users or the Platform may be at risk.

You may close your account at any time through your account settings.

Certain provisions of these Terms survive termination, including rights relating to content already shared publicly or used in prior promotional campaigns.

12. Disclaimer and Limitation of Liability

The Platform is provided on an “as available” and “as is” basis.

To the fullest extent permitted by applicable law:

we do not guarantee uninterrupted availability,
we are not responsible for user conduct or user-uploaded content,
and we exclude liability for indirect, incidental, consequential, reputational, or economic losses arising from use of the Platform.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law, including liability for fraud, intentional misconduct, or death or personal injury caused by negligence.

Our total liability relating to the Platform shall not exceed the greater of:

the amount paid by you to us in the previous 12 months,
or €100.

13. Changes to These Terms

We may update these Terms periodically.

Where legally required, we will notify users of material changes. Continued use of the Platform after updates take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed and interpreted in accordance with applicable international consumer protection and digital services principles, including relevant laws of the United Kingdom, European Union, and United States where applicable.

Nothing in these Terms limits mandatory legal rights available to consumers under the laws of their local jurisdiction.

Any disputes shall be handled by the competent courts and authorities determined under applicable law.
